Protect
Compliance — FDA & SEC Essentials
A simple, plain-English overview of the regulatory directives every Australiana Life Affiliate must follow. Reading this section and signing the two acknowledgements below is mandatory before you can complete the section and continue.
FDA — what you say about the product
ėNOS is a dietary supplement. The FDA limits the claims we may make about it.
SEC / FTC — what you say about income
Earnings claims are regulated. Honesty and disclaimers protect everyone.
Stay inside the lines
Use approved language, share your own story, and the rules become simple.
Part A
FDA — Marketing a dietary supplement
ėNOS is a dietary supplement, not a drug. Under DSHEA and FDA rules, we may speak about how it supports the normal structure and function of the body — but we may never claim it diagnoses, treats, cures or prevents any disease.
Why compliance matters
At Australiana Life, compliance is important. It is the law and it is enforced by regulators. Being in compliance protects you, your customers and the company.
As an independent Affiliate, you represent the Australiana Life brand every time you post online, send a message, share content or talk about ėNOS with others. The good news is that compliance is actually very simple when you focus on education, honesty and genuine product experiences.
However, we must never claim or imply that ėNOS:
- diagnoses
- treats
- cures
- prevents
any disease or medical condition.
This applies to:
- social media posts
- videos
- messages
- testimonials
- comments
- verbal conversations
- before-and-after stories
Keep It Simple
The safest and most effective approach is:
- share your genuine experience
- educate rather than hype
- use company-approved resources
- avoid exaggerated claims or promises
- always be transparent and helpful
You do not need to be a doctor or scientist. Your role is simply to share information responsibly and point people toward the educational tools and resources provided by the company.
Compliance protects everyone and helps maintain the long-term strength and credibility of the Australiana Life brand.
Please review the full Compliance Guidelines document carefully and acknowledge acceptance before proceeding.
Understanding dietary supplements in the U.S.
ėNOS is a dietary supplement, not a medicine or drug. Under U.S. law (DSHEA and FDA rules), supplements support normal body functions and overall wellness. The FDA does not approve supplements before they reach the market, so we all share responsibility for making sure our messaging is accurate and appropriate.
The Federal Trade Commission (FTC) also requires that any claims we make are truthful and can be properly supported.
The structure/function rule (and the required disclaimer)
You are welcome to share information about how ėNOS supports normal, healthy body functions. These are called “structure/function” claims.
Important: every time you make a structure/function claim, please include this disclaimer:
“These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.”
Examples — what you CAN and CANNOT say
Use these examples as your everyday reference. When in doubt, ask Ana to compliance-check your wording before you post.
You CAN say
- ✓Supports healthy blood flow and circulation.
- ✓Supports your body’s natural nitric oxide production through the eNOS pathway.
- ✓Promotes energy, vitality, and overall wellness.
- ✓Supports cardiovascular health and wellness.
- ✓Helps maintain healthy energy levels.
- ✓Supports exercise performance and recovery.
- ✓A great-tasting daily powder for convenient wellness support.
- ✓“Since I started ėNOS I’ve felt more energy in my mornings.” (your own honest experience)
- ✓“I love the taste and the fact that it’s a powder, not a pill.”
You must NOT say
- ✗“ėNOS lowers blood pressure.”
- ✗“ėNOS cures fatigue / erectile dysfunction / migraines.”
- ✗“Reverses heart disease” or “treats diabetes / Alzheimer’s.”
- ✗“Doctor recommended for [any condition].”
- ✗Before/after medical photos implying disease improvement.
- ✗“Replace your medication with ėNOS.”
- ✗“Guaranteed results in 30 days.”
- ✗Sharing someone else’s testimonial that names a disease.
- ✗Re-posting an unapproved flyer, meme, or graphic you found online.
Other important FDA / marketing guidelines
- Only use marketing materials that have been approved by the company.
- Do not create your own flyers, web pages or advertisements without Corporate approval.
- Always be honest about your independent Distributor status.
- Report any customer concerns or adverse events to the company right away.
- Follow all platform rules (Facebook, Instagram, TikTok, etc.) and anti-spam laws.
- Never share another person’s disease testimonial — re-posting it makes it your claim.
Tip for success: lead with value. Share how the product fits into a healthy lifestyle, why we thoughtfully included our supporting vitamins and minerals, and how people can build a flexible home-based business. This approach feels natural and attracts the right people.
Mandatory · FDA acknowledgement
Distributor Compliance Training — Acknowledgement & Agreement
I have read and understood the FDA Compliance Training above (Part A), provided by Australiana Botanicals Inc. DBA Australiana Life. I agree to promote ėNOS and the business opportunity in a truthful, compliant manner; to use only approved claims and materials, or obtain written approval for custom content; to include the required FDA disclaimer with structure/function claims; to avoid any disease claims or misleading statements; and to accept responsibility for my own marketing and business activities. I understand that following these guidelines protects both me and the company, and that failure to comply may result in corrective action, up to and including termination of my distributorship.
Part B
SEC & FTC — Talking about income
Income, commissions and the Rewards Plan are regulated by the FTC (and anti-fraud principles enforced more broadly). The core rule is simple: do not promise earnings you cannot back up.
Examples — what you CAN and CANNOT say about income
You CAN say
- ✓“I earn a commission when people I refer purchase ėNOS.”
- ✓“Results vary — your income depends on your own effort and skill.”
- ✓“Here is the official Income Disclosure Statement.” (then link it)
- ✓Sharing your own honest journey, including the work it took.
You must NOT say
- ✗“You’ll make $5,000 a month in 90 days.”
- ✗“This is guaranteed passive income.”
- ✗“Quit your job — this replaces a full-time salary.”
- ✗Posting screenshots of commissions without the disclaimer.
- ✗Implying that anyone is typical or guaranteed to earn what you earn.
Official Income Disclosure Statement
The statement below is the company-approved language. Always link or include it any time you publicly discuss income, commissions, results, or the business opportunity.
Income Disclosure Statement. Australiana Botanicals Inc. makes no promises, representations or guarantees regarding income or earnings. You should not rely on the earnings or results of other distributors as an expectation of what you may earn. Like any business, success or failure is determined by hard work and skill. All people and circumstances are different and your earnings, if any, will be determined by your own efforts, skill, dedication and effectiveness.
The rule of thumb
“If you wouldn’t say it on stage in front of the founders and a regulator at the same time, don’t say it online.”
Mandatory · SEC/FTC acknowledgement
